The seasonal tenancy contract is what makes a multi-month rental in Barcelona legal and safe. It is not a "shorter" residential lease: it is a distinct legal category with its own requirements. Signing a badly drafted one can leave you without protection or, the other way round, spark disputes about the term. What a seasonal tenancy contract is

It is a lease of a home for a use other than the tenant's permanent residence. Spanish tenancy law (the LAU) regulates it in article 3 as a "lease for use other than housing", which covers seasonal use. The legal key is that the tenant has their main residence elsewhere and occupies the Barcelona flat for a specific, time-limited need.

That is why the mandatory extensions of a residential lease (up to five years, or seven if the landlord is a company) do not apply. The contract lasts exactly as long as the parties agree.

What it must include

A properly drafted seasonal contract covers, as a minimum:

  1. Identification of the parties and of the apartment, with its land-registry reference.
  2. The reason for the temporary nature, stated concretely: job relocation, academic course, works in the tenant's usual home, permanent-home search, professional project, medical treatment, and so on. This is the element that defines the contract.
  3. Clear start and end dates. No automatic extension; if an extension option exists, it must say how it works.
  4. Monthly rent, payment method and any indexation.
  5. Legal deposit (one month for leases other than housing, though an additional guarantee can be agreed) and the refund period.
  6. What the rent covers: utilities included or billed separately, building fees, cleaning, internet.
  7. An inventory of furniture and kitchenware, ideally with photos, signed by both parties.
  8. Cancellation and early-termination terms: notice period, penalty if any.
  9. The flat's condition at handover and upkeep obligations during the stay.

Common mistakes to avoid

  • No stated temporary reason. If the contract does not explain why it is seasonal, a court could read it as a residential lease, with the extensions that implies.
  • Confusing it with a tourist let. A tourist let is by the night, needs an HUT licence and does not allow town-hall registration. If your stay is over a month, what applies is a seasonal contract, not a tourist booking.
  • A term longer than 12 months. Stretching a seasonal contract past a year weakens its temporary nature. If you need more time, consider a justified renewal or a different contract type.
  • An unsigned inventory with no photos. This is the main source of disputes when the deposit is returned.
  • Unregulated cancellation. If the notice period is not agreed, any early departure can end in an argument over unpaid months.

What you need to provide as a tenant

Typically, to formalise a seasonal contract in Barcelona:

  • ID document or passport (and NIE if you have one)
  • Proof of the temporary reason where possible: employer letter, course enrolment, project-based work contract
  • Proof of means: payslips, employment contract or statements, depending on the case
  • A payment method for rent and deposit

Frequently asked questions

Does the seasonal contract need to be registered? It does not have to be entered in the Land Registry. The deposit can be lodged with the regional body (INCASÒL in Catalonia), an obligation the landlord usually handles.

Can I register at the town hall (padrón) with this contract? Yes. The padrón reflects where you actually live. With the seasonal contract, plus the owner's authorisation if the town hall asks for it, you can complete it.

How long can it last at most? There is no exact legal cap, but beyond 12 months it is wise to review the category, because the temporary character fades.

Can I be asked to leave before the end date? No, unless you breach the contract (non-payment, damage, improper use). The signed term binds both parties.

What if I have to leave early? The agreed early-termination terms apply: usually a notice period and, where relevant, a proportional penalty. That is why this clause must be well drafted.
